Once It’s Out There, It’s Out There Forever.
Information travels fast, and people are using social media at all hours
of the day and night. Even if you post something and then immediately
take it down, that still leaves enough time for someone to see it and
either print it out, take a picture of it, or otherwise lock it into a
shareable format that makes it dangerous in court.
Maximum Privacy Settings Don’t Keep You Safe
Regardless of whether your account settings are set for maximum privacy,
there are still ways for other people to see what you post. Someone who
is motivated to get a glimpse of your wall, feed, or profile has plenty
of alternative means for doing so. If you don’t believe us yet,
consider that the Terms of Service you agreed to when creating your social
media account allow social media sites to pass your information to legal
and governmental authorities. (Yikes!)
Posting Anything About Your Injury Can Jeopardize Your Case
The end goal of any personal injury lawsuit is to get the compensation
you need to pay for damages caused by the negligence of the other party.
It may give you some temporary emotional relief to vent about your case,
the judge presiding over your case, the person you are suing, or your
injury itself, but it can (and likely will) be used against you if the
other party’s attorney gets a hold of it.
As a general rule, refrain from posting pictures of your injury, the scene
of the accident where it occurred, or any part of your recovery process,
including therapy, doctor visits, etc. These can be easily twisted to
misrepresent the true damage caused by your injury.
